    Default Minor Caught Shoplifting at Kmart

    My question involves criminal law for the state of: Hawaii

    On Friday I got caught shoplifting at Kmart. I was with a friend but she was let go, and I was taken in. They brought me into a room and started asking me questions and told me to return whatever I stole. The lady was typing out some type of form, along with pictures of the items taken. After that, I was taken into a police department until my mom could pick me up--they took my fingerprints and pictures. This is my first time shoplifting, and the items were about $40 worth altogether. I was also told by the lady at kmart that I couldn't go there for a year if I'm without my parents, I'm 14. My mom was told that we're gonna have to go to court, but was also told a lawyer wasn't needed since it was on camera. Honestly, I'm scared but my question(s) is: what is court like, or what am I gonna be required to do? Also, what could be the possible consequences for my situation? Thanks.

    So you're old enough to have the good sense not to go to the Kmart without your parents during the coming year.

    Being caught on camera has nothing to do with whether or not a defendant needs a lawyer. The question is whether a lawyer can do anything to improve your situation. For a first offense shoplifting charge, assuming you have a good home, community and school record, and no prior police record, it's possible that a lawyer will tell you that he can't do much for you to improve your likely disposition, but it is appropriate to find out from a local juvenile court lawyer how the local judges treat this type of case before making any assumptions. If your background is more troubled, all the more reason to consult a lawyer.

    Your mom is almost as much of a fool as you are. The fact that you are guilty doesn't mean you don't need an attorney.

    You can expect a letter from KMart's "attorneys" demanding $120 or so in compensation independently.

    If you haven't been in trouble with the law before, you can count on probation, and having to take a theft course (which will run about $100 or so) as well. There will be costs paid to the state for your prosecution.

    So in the long run, this is going to cost you/your parents, money: lawyer, civil demand, shoplifting course, court/probation costs.
