    Default Moving out of state - TX to IL

    Hi there! I am currently on probation for DWI that occurred in April of '06, though I did not go on probation until September '06. To make a long story short, I am now pregnant, due at the end of May, and my husband and I would really like to move to the Chicago area (where all our family is) before the baby comes. I will have completed all terms of my probation, victim impact panel, driver's ed course, drug and alcohol eval, community service, etc, by January. Finding housing and jobs would not be an issue, his company has already agreed to transfer him, and I substitute teach so that would be an easy move as well. The only problem is, I met with my PO yesterday, and while she did make a point of saying it would not be "impossible," she also said it would be such a hassle that we should just wait until next November - I am off probation in December. Now I had to leave her office before the crying started (I'm pregnant and emotional, the slightest thing sets me off, unfortunately) so I didn't get to plead my case before her, and so when I left I think she assumed that since she said it would be easier to wait, that's what I would do. But I've had time to think about it, and quite honestly the hassle of going through a mountain of paperwork and red tape right now sounds much less daunting than the prospect of having to move 1,000 miles with a five month old next year. So, basically my question is, how should I approach her about this when I go in next time? Is this something I really need to get my lawyer involved with, or should it be enough to just talk to her myself? And what am I honestly looking at in terms of a timeframe, paperwork, and fees? My biggest fear is that my husband's company is going to now force him to transfer, and I'm going to be left here in Texas by myself to finish my pregnancy, have the baby and raise it for five months before I am free to leave. On a sidenote, this was my first offense and the only contact I've ever had with the law. Any advice would be much appreciated, thank you!

    Consult your lawyer from the criminal case about the chances of transfer, and how to approach the probation officer. It may be necessary to bring a motion before the sentencing court.

    Note that even when your probation officer is cooperative, the transfer of probation can be a relatively slow process - it's not something that your probation officer can do alone, but must also be coordinated with a probation department in your destination state.
