    Default Payday Loan Taken in Somebody Else's Name

    My aunt has a company calling her and telling her she has a payday loan out that she did not to, but the twist here is it has my email address with her info...they say the money was deposited into a bank account unknown and that then the account was closed. She is filing a fraud report and said she needs to file fraud charges against me even though I did not do this, what can I do?

    Not much you can do until or unless the police contact you.

    A lawyer told her to go file a police report today.she says it has my email address, but I didn't have a bank account at that time.what can the police do?

    They can subpoena or serve a search warrant on the bank asking for information on the account holder ... they can serve your ISP with a subpoena or search warrant seeking your email account info and history ... there's a lot they CAN do. What they WILL do is the bigger question.

    Depending on the value of the loss, the police may merely provide your aunt with a case number so she can use it to settle the matter with the payday loan company. The real victim appears to be the payday loan folks and depending on their loss they may want to pursue it themselves, or write it off as a loss.

    Loan was $800 they say they want $1800, they are based in New York, we are in md.
    We were going to try and pay them at a lower rate and they said the litagator
    Wouldn't talk to us anymore and said papers will be served

    It sounds as if they are suing your aunt ... or you ... or both of you. It might be a threat designed to scare her/you, it might not. It's not a large amount so I doubt they are going to pay to sue you in M, but, maybe.

    If neither of you did this, then your aunt should consider making that police report for fraud. If you DID do this, or she did, then you might want to consider how to settle the matter so as to avoid criminal charges for fraud - and that would likely entail speaking with an attorney, first.
