    Lightbulb How Soon Can You Get a H1-B Visa and Start Working for a Tax-Exempt Employer

    Hi there,

    I have an urgent question to ask, and I really appreciate your helps on this matter.

    I am currently on F-1 visa, and just started my OPT grace period. My OPT won't start until Oct, 2014. Just yesterday, I got a job offer from a university education foundation, which qualifies for 501(c)(3). They need me to be on board immediately. I am wondering (1) whether I am eligible to apply for cap-exempt H1b, and (2) have the H1b effective before Sept 15, 2014 if I go through the premium process (and whether this premium process still exists).

    Not all non-profits qualify to sponsor non-cap H-1B visas. The international office at the university likely handles visas for their foundation and would be able to tell you if the job you have been offered qualifies. By the way, you cannot apply for the H1B; that is the employer's responsibility.

    It makes no sense that you are in a "grace period" and cannot begin working on OPT until October.

    If you were a student at the university whose foundation you intend to work for, you really need to sit down with the DSO and international faculty/staff officer and review your situation.

    Thank you very much for the reply.

    The university I attended and the university foundation I will work for are two different universities. The university foundation is the US office of an oversea university, and people there have no experience on this matter. But I will definitely check with my international student office about grace period.

    Is there a place I can find out whether this university foundation is eligible to sponsor non-cap H-1B? Thanks a lot!

    Overseas university with a foundation? This sounds really strange. The fact they have no experience with work visas tends to indicate you will have a problem. They should have an attorney advising them and should ask the attorney. You as the employee can do very little when it comes to work visas since the employer is responsible for the filings.
