My question involves employment and labor law for the state of: Minnesota
I have been working for this company for 7 months. All my issues have been going on for much longer then I have been working here for. I am the companys truck driver/laborer. we do a special kind of concrete called gypcrete. Any ways, i get paid bi-weekly. and of the 7 months i have been with this company i have had 4 checks that were right, i have been shorted hours,per diem and OT. Not all in the same check but they have been wrong more often then not. Also a couple months ago we did not get payroll checks, we got personal checks from the owner of the company with no paystubs. I have requested paystubs and i get nothing. also we work LONG hours and only get breaks when our pump breaks down. which doesnt happen hardly. maybe 3 times a month, MAYBE. ive worked 27 hours straight one time with a 30 minute break and only got that because the truck needed to fuel up. i average 65 hours a week, m-f and this last pay period, not a single break. No 15 minute break, no lunch break nothing. It is everyone in the company that gets treated like this except for office personnel. I have contacted the MN department of labor and the attorney generals office, I was told by them that they will be opening an investigation. Are there any labor laws that are being broke by them not allowing us to take breaks and not providing proof of pay or pay stubs?what other options do i have. because with out my pay stubs i cannot set up a payment plan to pay my college off so they keep freezing my account and draining it. I thought about talking to an employment attorney but i do not want to be wrong about laws and look like a fool. What options do i have.
P.S. Also i have it set up to have my child support taken out pre tax. Well they were deducting it but not submitting the payment. So i have been threatened with jail time.
