    Default When Can You Get Early Discharge from Prison and Parole

    My question involves criminal law for the state of: colorado

    This may be a silly question. I apologize.

    I am wondering if it is possible to get early discharge from a prison sentence while in prison. My friend had his parole revoked. He is finishing his parole in prison. He has done over 1/2 of his parole. He will be completely discharged in March 2015. He is not a violent offender and has had zero write ups, has a job inside, and attends classes.

    I know that inmates that are paroled outside can have their parole early discharged after serving 1/2 of their parole.
    Just wondering if that is also applicable if they are serving their parole in prison.

    That is the purpose of parole hearings. They are done on a scheduled basis.

    No I'm not talking about being paroled. I'm talking about being discharged....off paper....done with the sentence in all of its entirety .
    He had a parole hearing in April. He was denied for not serving enough time yet. It's been long enough now. But he will NOT have another parole hearing . He will discharge completely at the beginning of 2015 , unless he is able to get an early discharge now.

    If that's even possible. That's what in asking.

    I suggest he ask his attorney. In such a short period of time he likely had one bite at the apple and that was, according to your story unsuccessful.

    Ok thank you. He has a public defender that is not returning his call. And a case manager that says" it's not her issue or concern". So I was hoping someone on here could help.If so he could talk to the parole board and file it himself. I just didn't know if early discharge while in prison was even done. Like I said he has 7 months left of parole. He has done 12 months.

    Given that his parole was revoked, I don't see anyone in the system falling all over themselves to get him out 6-7 months early. He had his chance and apparently blew it.

    Yep. Very true. But also cdoc is being sued for not giving credits that are stated in the co statutes . If it becomes a class action and if monetary resolution accompanies the case resolution, cdoc would benefit from shaving some days off for some inmates. But I know that's outside of the box thinking. He screwed up and has to do his time. I realize that. I was just curious. March it is.

    One of those circular arguments. The state gave him a break but did not give him enough of a break when he violated the first break. Not saying your argument is wrong as a matter of statute, just as a matter of taxpayers accepting leniency in their judges rulings.

    I don't fully understand what you meant by the last part. I'm not real bright obviously.

    The taxpayers are paying for over 20,000 inmates to be incarcerated past their mrds because of cdoc miscalculating good time and earned time credits that should have been applied per a co statute. When these inmates ,getting free food and shelter, should be out working. Paying for themselves. If they are not a threat to society that is.

    Parole and probation are privileges. A court could just lock someone up for the state max and the judicial system wash their hands of it. Think of Charlie Manson and his girls.
