    Default Delay in Job Offer Due to a Late Background Check

    My question involves labor and employment law for the state of: North Carolina
    This is kind of complicated and long. Here it goes, Training was to start 7/21, but the background check had to be back before 7/18, but it wasn't. I asked about the background check. It wasn't back yet so I couldn't start training and they didn't have another class. I was asked about licensing in different states and I said no I didn't have any. I was told that's what was on my background check and that's why its still pending. I asked for them to mail it to me, they said they did, to my old address. but in reality they didn't. so now after contacting them 2-3 times a week since the 18th of July, I'm still looking for it to be mailed to me. I asked for a supervisors name and number but was told that was against company policy. The young lady called me back and offered me another position with training beginning the 8 of Sept. with the hours of 3:30-12am. What, is my background good enough now? I have not heard anything about it, but I want to sue them for the run around and thinking that my background check was being mailed to me and they dropped the ball and just don't want to say, "I'm sorry we mad a mistake". Of course there's more to say about this but I tried to keep it short. Please let me know if you need more details, cause I have them. Thanks

    No, you can't sue.

    Perhaps they figured out you were going to be a bad fit.

    Or to put it another way, if you were to try to sue for this, you would lose - assuming a judge ever let it get into a courtroom to begin with.

    They do not owe you a job, training or any compensation for failing to give you either.

    There's no lawsuit here.

    So forget it and move on.

    PS: This won't be the last time stuff like this happens so get used to it. It's how work works.
