    Default Interstate Collection and Modification of Child Support Payments

    My question involves child support in the State of: Maryland and Georgia

    I currently reside in Maryland (Custodial parent). I know this would be an interstate case, but I'm trying to understand how this process works in it's totality re collection and enforcement. My issue is slightly complex but I dont want to make it more complicated hence being on this forum.

    I went to the Child support office in Maryland to modify a case, well the representative provided incorrect info. She told me to open a case and that CS office would contact me with an interview date/time. Well guess what that never happened. On that day all I did according to the Child support supervisor was open a case for enforcement because the representative did not give me the correct info which was to go to the courts to file for a modification. Child support to date has sent a notice to me and my ex to forward $25 per month payment (was in a final divorce order back in 2010), and sent my employer a medical support notice to have my son added to my policy. It all was turning into a nightmare for me because what I went to child support for was a modification not an enforcement of $25.00 and to pay an additional $100 per pay to have my son on my health insurance. Note my son was on the Maryland Health insurance premium plan at the time of my divorce.

    Well I sent letters to the Child support supervisor and was contacted. She explained that child support is only an ENFORCEMENT agency and not for either parent nor the child. She stated as a one time courtesy she would allow me to close my case due to being given incorrect information. However that if I wanted to reopen I could but would not be able to close the case if I'm unhappy with them. She also stated interstate cases could take up to 1 year. So now my head is truly spinning. Please help! If I need to give you all info I will but just need some clarity.

    My question to you all is if this is an Interstate case does child support have to be involved?

    When I go to the courts and file a modification, how does the state of Georgia come into play?

    If I don't involve child support enforcement agency how do I go about collecting payment? Could I still get an income withholding from his employer?

    Lastly how do I go about getting a supeona of wages from his Georgia employer?

    Should I leave case open and just do a modification? I guess this all depends on if in order for interstate to work that only Child support enforcement could help?

    Also please forgive me if this should be under interstate and not collection and enforcement.

    Thanks I've actually reviewed the 1st and 3rd link prior to posting. I'm just trying to figure out if it's better to include child support agency, close case, if they have to be involved if interstate ... etc. The processing time up to a year is ridiculous and this is coming from the child support supervisor ... thanks again so very much.

    The thing about going through the state is that they are better equipped to collect on the court order. NCP has arrears? Goodbye tax refund, without you having to do much. NCP still refusing to pay? CSEA can handle getting things like licenses (driving/fishing/hunting) suspended. The state has better ways of enforcing the order than you do.

    Which state entered the original support order? If it was Georgia and dad still lives in Georgia, you'll likely need to file in Georgia to modify support.

    Final divorce order that included separation agreement is in Maryland where I live with child. I believe that means Maryland would be the initiating state. Ex moved to Georgia in 2012.

    Modification would be filed in Maryland.
