    Default Can I Go to Small Claims Court to Enforce an Order

    My question involves child support in the State of: Nevada

    My divorce decree states out of pocket medical expenses not covered by insurance are to be split evenly. Party A has 30 days to notify Party B of the expense. Party B then has 30 days to repay 50% of that amount to Party A.

    My son had a medical expense of about $2,000 and his dad continues to refuse to reimburse my half. Our son was uninsured at this time because his dad was between jobs. The court order also states that dad is required to provide medical insurance as it defrays his total out of pocket child support payment.

    Can I seek remedy in small claims court or do I have to go to family court? It seems like small claims court is a lot easier and more DIY. I would like to get this reimbursed without needing to get lawyers involved.

    As a general rule family court is the correct venue and even more so here since the order itself would commonly make it Dad's insurance obligation only if he can reasonably afford it.
