    Default Do You Have to Follow a Marital Dissolution Agreement Before Its Entry as a Judgment

    My question involves a marriage in the state of: Tennessee

    I am in the middle of a divorce. We are waiting for the final court date for the MDA to be approved. My wife keeps sending me emails and texts saying that I am already in contempt for not following the provisions in the MDA and she is going to sue me. I would think I do not have to follow the provisions/stipulations of the MDA until it is final. The MDA states in several areas, "...upon final decree" and "upon execution of this agreement." I would think that it is not a final decree or that the MDA hasn't been executed until a judge signs off on it. By provisions, I mean such items as helping her pay for medical costs, alimony, division of property etc.

    You cannot be held in contempt of something that is not part of a court order. If your question is intended to go beyond that, we are not in a position to know if the actions that your wife believes to be in defiance of the agreement are of the type that would frustrate the agreement or if the delay is causing your spouse to suffer undue hardship, and you should discuss the details with your lawyer.
