A collection agency (LR Credit 10) sent me a notice on a law firms letter head (Mel S. Harris & Associates) asking me for payment on an account I did not recognize. Since I am not in the habit of paying debts that aren't mine I wrote to them asking for them to validate this debt. I wanted a copy of the original application showing my social security number, DOB, and my signature because for all I know this could be a case of fraud. Anyway I never heard back from them and now I received a summons in the mail telling me I'm being sued and have 20 days to answer the summons.
Is it legal to sue without validating a debt?
Did they violate some FDCPA law?
How do I proceed?
