    Default Sexual Harassment by an Administrator

    My question involves labor and employment law for the state of: Virginia

    I am the manager of a medical practice. I have an administrator and HR person who are above me. I was brought in for my yearly review about a month and a half ago. My administrator told me that "He should kiss my ass for all that I do." My HR person was in on this discussion and witnessed the whole thing. I am now having some discrimination problems with my administrator and wanted to know if this conversation would be considered sexual harassment? Thank you in advance for any help. I am new to this forum and I hope I provided all information needed.

    No, its not sexual harassment. You should have let him know that you didn't like that comment, so the next time he states it, it would be considered sexual harassment.

    Actually, I don't see where it would be considered sexual harassment even if it happens again, since there is nothing about the phrase that is sexual in nature as used colloquially.

    I agree. I think it was just an unfortunately crude way of saying "You're a great employee!"

    With sexual harassment, it doesn't matter what the intent was of the person who made the comment. All that matters is how it was perceived by the "victim". Sure you could file sexual harassment if you perceived that comment to be degrading or of sexual innuendo. Are you going to hit a pay day because of this? Absolutely not. So you can also quit your job so that you don't have to be around someone who treats you like that.

    While I understand, and to a certain point agree, with the point PADriver is making about perception, the fact remains that a single instance of the type described is NOT sufficient to sustain a sexual harassment suit.
