    Default Is it Illegal to Edit an Email That You Have Received

    My question involves criminal law for the state of: Florida

    My wife received an email from her daughters father. In that email was an attached email that he was stating we sent about one week later then we actually did. I verified in her sent mail that it was sent when we said that it was. when I checked the email header on the original and the one that was attached. The expected result was that they would be the same. However the one that was attached by the father was not and was missing normal email header info and had a changed date/time field. This leads me to believe that he has purposely change the email. Our concern is that he will attempt to use this email in up and coming child support and time sharing modification that we are filing for. Is this illegal or just frowned upon? If it is illegal what would our options be?

    Just to note that I am an Email server administrator and that is why I know that this email was modified.

    It's not illegal and it's not frowned upon.

    What counts is the content of the email and whether or not that content is authentic if it's going to be used against you.

    Maybe you should explain what's in the email and why you think a change of the date and time would give him any advantage.

    The email was telling him that he could come to a restaurant that day to see his daughter. He changed the date that the email was sent to make it appear as though we sent the email a week later than we actually did. Our fear is that he would try to use this toy sway the judge or magistrate to change the time sharing or child support in his favor.

    Well you have the original email with the time and date sent so what are you worried about? You can always submit that to the court if and when the time comes.

    I shouldn't have to tell this to an Email server administrator but print out the source information of the original email. Anyone can change the time and date of an email header when they attach, forward, or reply but that doesn't change the source coding of the original.

    I wasn't worried about refuting it I guess I just wanted to see if there were any legal actions we could take.
