    Default What Information Can a Parent Obtain About Stepparent's Health Insurance for a Child

    My question involves juvenile law in the State of: Texas

    I am a father who shares equal rights to my child except choosing residency. My child is covered under my health insurance as primary, but is also covered by her step dads insurance as a secondary.

    What should I have to do in order to gain access to her explanation of benefits for this secondary policy?
    As the biological father with equal rights as mom, shouldn't I be able to have access?

    Why do you want access? Stepdad is not a party to your custody order therefore he has no obligation to provide you any of his records...and particularly not any kind of online access to his EOBs. If there is specific information you want you might be entitled to that information.

    I want access to ensure that I am aware of all medical visits for my child. As it is now, I have no knowledge of doctors or clinics unless it was filed on my insurance. I realize that I cannot gain access to his EOB portion, but if my child sees a practitioner, I want to know and cant rely on child's mother to inform me.

    I am not looking to force him to grant access because as you said, he is not a part of my existing order. My main question revolves around working with the insurance company to gain access to the childs records only.

    Unfortunately I doubt that the insurance company has any process in place to only give you limited access. As far as I know either you have access to all of the information under a policy or no access at all.

    Nor does the stepfather's insurance company have any duty to inform you of anything.

    You would not even have access to that information if your ex was the one carrying the insurance. You need that persons permission and they have to normally fill out a form to their insurance company. I had my son on my policy, he turned 18, still on my policy and to get any information from my insurance company, I had to have my son fill out a form granting me permission, lol. Privacy laws, while a pain, they are there to protect your privacy.

    If you have joint legal you and mom should be discussing medical together. You can request medical records through the care providers. If mom refuses to share information, you will have to take it back to family court and have the court do something on it. Have you looked through your court order for anything in it dealing with medical? I know of a few orders that have several spots in the court order dealing with medical. Some have things in their order that address how and when a parent must inform the other parent when medical care is given on their time.
