    Default Bankruptcy Options for a Large Medical Debt, Income Too High for Chapter 7

    My question involves bankruptcy in the state of: Oregon My daughter, who is a teacher has a salary of about 65,000 and owes $80,000 in student loans, Recently she had an elective surgery, for which she paid cash, since her insurance refused to cover it. Hospital stay was supposed to be 3 days. Her surgery did not go well and she developed peritonitis, had emergency surgery, still had peritonitis had a third surgery within about 7 days. She spent about 8 days in ICU and has been in the hospital now for 16 days. Her insurance refuses to pay a major part of the fees. I expect the bill to be several hundred thousand dollars. I believe she makes too much money for a Chapter 7. She is paying off her student loans and buying a house and cannot pay this huge bill. Any suggestions for her?

    At the moment there is nothing for her to do except concentrate on her recovery. Once she is past the health issue she should meet with several bk attnys to explore her options - consultations are usually free. She has plenty of time to figure out what to do.

    Don't count out Chapter 7 until you speak with an experienced bankruptcy attorney and have the case evaluated.

    Student loans and medical bills are considered non-consumer debts by many courts. If your daughter's debts are not primarily consumer debts, meaning over 50%, then the bankruptcy means test does not apply to your daughter's case.
