    Post Getting a Work Visa if You Don't Qualify for a H1 Visa

    I am an international student from Venezuela and recently obtained my Associate's Degree in Business Administration. I have been living in the US since January 2011, I am still in good status because I apply for OPT after graduation and have about 5-6 months left of the 12 month period of OPT. I got a job as a Technical Designer of a Roof Truss Company and they made advances asking me to apply for a work visa and allow me to continue working there. Due to the fact I only have 2 years of school and this is in fact my first job, I do not have the require 4 years of school to apply for a H-1 visa. I have already discuss my case with other lawyers and say that it is still possible to apply for the h-1 but it is not likely to be approved, and due to the nature of my work I do not qualify for an H-2 or H-3. So my other option is to go back to school but with the current situation in my country the financial assistance from my family over there it becomes increasingly difficult to obtain the necessary financial assistance. I have a girlfriend she is an american citizen we have been together for over 2 years now and we both intend to get marry. However we both want to travel and work for a short period of time (between 6 to 18 months) in Europe or Australia, the problem is that if we were to get marry I cannot leave the country for that long of period of time (no more than 12 months), not until i become a citizen which I am told it may take up to 3 years after marriage. and we don't want to wait 3 years to travel. Knowing all of my case I have some questions about it. 1. If we were to travel would it be easier to get marry and travel or vice versa? 2. If we were to get marry while traveling how does that affect my leaving and reentry in this country? 3. Due to the current situation in my home country can I request all my turist and work visas from US consulates or the embassy? 4. What would happen if we are marry and my wife is on a work visa elsewhere? Can I apply for the partner visa and remain in status and be allowed reentry to the US with my girlfriend?

    Actually, permanent residents can apply for "reentry permit" which preserves residency for up to a two year absence. Read about this at the US government website.

    Mr. Rodriguez, if you are working full time then you will have additional financial resources. At one time in my life I attended school full time while also working full time. It is not an easy task, but with online course options it can certainly be done. You might explore what is possible of you just dig deeper within yourself and work harder. It might not be a fun 2 years, but it might be the best investment you ever make.

    I often wonder why people respond to posts here when it is clear they have absolutely no desire to be helpful.
