    Default Can You Get Released from an Extradition Hold to Voluntarily Surrender

    My question involves criminal law for the state of: Texas and New Mexico
    My son is in the Dallas County Jail on charges from New Mexico. He has signed a waiver of extradition. He is charged with Shooting from or at a moving vehicle which is a 4th degree felony in New Mexico. He did not shoot anyone but he was shot in the arm and has had two surgeries on his arm and is due for another surgery in August. He is Texas because he is under a doctor's care. He did not flee New Mexico. No charges were filed when he left New Mexico and the detective knew where he was but did not contact my son to let him know of the charges. Can he get out of jail in Texas and turn himself in back in New Mexico?

    Your son's lawyer can suggest that possibility to the prosecutor handling the case in New Mexico, to determine whether the prosecutor will go along with the proposal.
