    Default Required to Take Work Time Off for Landlord Arranged Repairs

    My question involves landlord-tenant law in the State of: Georgia

    I am leasing a single family home. A tree fell and damaged the home during a storm. The landlord has a contractor to repair the damage inside and out. Estimated 2 days of inside work to repair and the landlord is requiring that I remain at home during this time. I have a full time job and do not want to take this time off.

    I asked if the landlord or his spouse attend the house during the repairs and they declined. My lease does not have any requirements for me other than making minor repairs of $500 or less and then subtracting from the monthly rent. The landlord is not willing to see if any weekend dates are available so I will only have to take 1 day off from work.

    As this damage exceeds $6,000 and is managed entirely by landlords, am I required to leave work so contractor can work inside the house?

    Does your lease address the issue at all?

    Even if your lease required you to be there I don't think it would be enforceable.

    One thing you can count on is this. If a contractor estimates 2 days for the work, I can guarantee that it will take longer than two days.

    You have no obligation to be there while the work is being done and are free to tell your LL that you aren't going to be there.

    Just make sure you photograph everything in the house, make a record of serial numbers, and lock up your valuables. Otherwise things will disappear.

    No, the lease does not. It only addresses that the tenant is responsible for minor repairs up to $500. The landlord is responsible for repairs of $501 and up. That is all the lease addresses.

    I agree with Adjuster Jack. Just tell the landlord that you cannot get off work to be there.

    Since you are allowed to deduct $500 in repairs from your rent, why not propose to your landlord that you deduct your lost wages from your rent? See how s/he responds to that proposal. It is not reasonable that you should incur a loss of income because of damage to rented property caused by a diseased tree or storm.

    There is nothing in Georgia landlord/tenant statutes that says you have to take off work to be there.

    You didn't cause this damage. If the landlord is so concerned that someone must be there, they (or their property manager if they have one) can remain in the unit while the work is being done.

    The landlord may be covering himself from 'misplaced' items while the contractor is there, not too unusual when dealing with an unknown contractor. In some areas the contractor would be considered his representative, and he is in line for any damages/stolen property while the contractor is there. It should be fine to have a friend or relative there instead, discuss it with the LL.
