    Default How to Arrange to Have Your Children Born in the United States

    To whom it may concern:

    I would like to ask a few questions about marriage. I am male US citizen married to a female non-US citizen, both currently based in Yemen. We are considering expanding our family in the future, specifically my wife is a Yemeni citizen and I would like for our future children to be born in the US to enable them to obtain US citizenship since I have not lived in the US for the requisite 5 year period to allow our children to have automatic US citizenship derived from me. Can you advise me how to proceed in this issue? Would it be possible for my wife to apply for a non-immigrant visa? Is there any specific documentation that can be provided that can help e.g. a letter from US citizen detailing the situation, health insurance, etc.? Both my wife and I are currently working in Yemen and have no intention of moving permanently to the US. We simply want to ensure that our children obtain a US citizenship. Thank you for

    The rules apply to all. Unless they are physically born in the US, they will not become citizens at birth. Since you do not intend to live in the US at this time, why are you worried about it?

    You can easily address the issue later should you and they come to the US to live. I hope you realize that US citizens are required to file taxes on their world wide income with payments due to the US treasury dependent upon tax treaties. I hope that you have complied with that law. It might become an issue if you decide to file for permanent residency for your wife in the future. It is recommended that you file even if you owe no taxes to the US government.

    Your wife is unlikely to be able to obtain a non-immigrant visa since you are a citizen and there is the presumption of intent to immigrate. They do not give visas to permit births in the US even if the father is a citizen.

    If you decide to make the US your home, she should receive a green card easily as the spouse of a US citizen provided you can meet the financial support requirements.

    The only way you can insure your children are citizens at the time of their birth is to make the US your home so your wife will have a green card at the time of the child's birth.

    I also hope you properly filed with the US Selective Service.

    On what visa? You certainly are not advising that she sneak across the border with the illegals.

    But if she did, she'd hardly be noticed among the millions of others who have their babies here.
