    Default Roommate Told to Leave and Threw Key at Me

    My question involves landlord-tenant law in the State of: Colorado

    I will give you the full run down as I am not afraid to be 100% here. Please grill me with any serious questions regarding this matter as I would like to have my head fully wrapped around the legalities.

    I let a former coworker rent my 2nd inside my apartment. This period extended from June 1-July 19. He was asked to pay less than half of the total rent on a month by month basis at a rate of $375 per month (total rent over $1100)with the verbal agreement that electricity would be split in half (I even said I prorate based on my usage if it is more than half, more than fair) as well as a verbal agreement that any damage to my property would be repaid. During this period the rent was not paid on time (first of the month, June 1 and July 1). Instead it was given to me in half payments one and two weeks later. Also, I allowed his 2 pets inside my home where they proceeded to urinate and defecate on my carpet well over half a dozen times. I consider this damage to my apartment companies property. I told him in these exact words on July 18th, "I'm done". He proceeded to move his belongings out the very next day. He was not forcefully removed, but by his own choice. I feel like because of this I am not bound to return the prorated rent. I have not received any money for his electricity usage and he removed property from porch. The property was a grill that for which we had split the cost (I paid for this item upfront and used my truck to pick up). Until I receive the half of this, I consider the grill to be stolen. Nothing was discussed, he simply took it. During his stay at my apartment I cleaned his own feces off my bathroom floor and all over toilet seat on two separate occasions before having to leave for work, also his animals urine before work. This is unsanitary and unacceptable. When I had decided that I had had enough it was based on this collection of issues as well as my coming home to find that all my windows were left open and the cat had once again urinated on my carpet, but had zero access to its litter box. He had closed the door to where the cats litter box was located. I also live in a garden apartment where anyone could have cut the screen and stolen every one of my personal possessions. I wasn't able to get back to my home until about 8:30pm and he had departed from my town to Denver (which is about an hour south from my town) to visit his girlfriend). This is plenty of time to have my things stolen including my dog. When he took the last of his possessions to the moving truck he aggressively threw the key at me which hit my forearm and caused zero injury, said something that my friend and I could not understand, and slammed the door. My friend is a witness to this particular event. We said nothing and did not react in the slightest to these actions.

    Here are the things that you need to know alongside of this. He was not put on my lease nor were his pets and this is required by my lease. My apartment manager and I have a very nice relationship and she is quite understanding of me as a person. She will be pleased at the corrective action I have taken in order to preserve the quality of the apartment and lives of my neighbors around me. Also, I have always paid my rent on time and in full. Finally, I have paid him $20 for the half of a months worth of internet usage of this month. The internet is unavailable because he has taken the equipment and I have paid for 19th through the end of this month. Not much money, but this is about principle at this point. Lastly, the internet, which is in his namem, is under a 1 year contract through centurylink. I did not give a verbal agreement that I would pay half for the entire contract, but I was paying for half while I am using the internet and it is connected inside my home. That's the full story as I can remember. Please correct me or explain to me anything that I am confused about. What actions should I take? He is only 22 years old and I can simply contact his parents, but I have asked him to be a man, pay his dues, and apologize face to face. I gave him until 3pm today to take action or I would be forced to take action myself. If he does not respond and his parents do nothing then what should I do? Also, I can calculate the electricity cost if anyone needs to see those numbers. Thank you for your time.

    What type of actions do you think you can take after this person?

    You told him "I'm done"; he moved out. You want to sue him for taking the grill, then sue him but produce evidence to the court that you own the grill.

    You want to sue him for his share of his electricity used for July? Seriously? Give it up and be glad he's not suing you for the rent he paid through the end of July.

    Most of the rest of the stuff you posted is meaningless legally and just filler. You don't get to sue someone for things that "could" have happened like leaving the windows open or throwing a key at you.

    Understood. The total amount of damage calculated including bills is $135.12. Am I to pay for this? I'm not asking to sue for things that could have happened. I was stating my reasoning for asking him to leave. He still has a room sitting here. How can he sue me for this when the door is still open for him to walk in and live there? I did not file any eviction papers and his departure was voluntary so I am dumbfounded by your response. I want the money for the damages and unpaid bills. Are people allowed to throw things at you? Do you find this acceptable?

    Also, the grill was removed from my property. So he literally could have walked out with anything of mine and because I cant produce a receipt it legally becomes his? That doesn't make sense.

    So sue him for the $135.12 and be done with it. If you add the grill to the lawsuit the court is going to ask you to prove that you own it and thus, your suing him for it is justified. In other words, if you add this to the lawsuit, the responsibility of showing this was your property would be on you. How do you plan on proving this to a court of law?

    Quit whining about him throwing a key at you. You stated you had no injury from him doing this and frankly, it makes you sound like an idiot.

    Oooh, the "I'm a MAN!" gambit. Put your testicles away, darling, no one cares. I can't imagine why you think your mildly bruised ego is of any concern to anyone, and I'm astonished you wasted the time to fuss about having a key thrown at you to begin with.

    You want an apology? Good luck. You're going to tattle to his parents if he doesn't "be a man"? He's a grown adult. If you whined to me about my 22 year-old son, I'd laugh at you and hang up.

    Don't be a horse's ass. You got solid legal information from a seasoned landlord. Take it or leave it, you're unlikely to get an answer you like more.
