    Default Fired by My Family Doctor Without Warning

    My question involves medical malpractice in the state of: South Carolina

    Hello,

    I am a 28 yr old female who started seeing a new physician a little over 3 years ago. From the time of my first visit, I have been prescribed Adderall 20mg TID, Xanax 1mg TID, and Prozac 30 mgs once daily. I have taken these medications as directed for 3 years. Recently, the office manager called and said they canceled my upcoming appointment due to missing 3 appointments, ( one of these was an error on a receptionist who gave me the wrong date and time). So any who, I have been forced to stop all medications cold turkey. I am since lost my job, due to the severe depression and withdrawal symptoms having steamed from the Xanax and Prozac. I cannot function without my adderal after being on it for years. I tried to contact the physician to see if he would see me one last time and taper me off these medications without just cutting me off but he refused. I have been very sick and like I said above, severely depressed, not getting out of bed for days at a time. I also recently had a miscarriage, which my ob/gyn has said could be caused my the stress I have been under trying to piece my life together after having my vital medications taken from me.

    Do I have a Malpractice Case??

    You have a negligence case. You were negligent in following your doctors care to be prescribed these meds so the doctor discharged you as a patient. Since suing yourself would be a waste of time and money I suggest you follow appointments with your new doctor.

    Why did you choose not to seek follow-up care from a different doctor or psychiatrist?

    I have been adamantly trying to get in with a new doctor, but all offices have said that they are so booked that it will take a couple months to get in for a new patient appointment.

    Well the way my doctor has always treated me , he saw the for the initial visit, prescribed me all these medications, and has required me to come into the office 3 other times in 3 years for an appointment. I have always kept my appointments unless something urgent has come up, which I called and notified office asap. The other was an error on the receptionist part. ONLY ONE of the missed appointments have been actually my fault where I did not write it down and missed it. I do not expect him to treat me without being seen, quite the opposite.

    I was never given notice, the night before my scheduled appointment, the office called and canceled it saying that due to the missed appointments I was dropped as a patient. Bottom line. I explained to the office manager what happened and she sent me a letter saying the could no longer treat me. Also, I am not a "red-flagged" drug seeker. All the of the medications I have been prescribed my Ph. after his mental and physical examinations. He also prescribed the Xanax without ever seeing me in the office. I called and left a message with his nurse that I THOUGHT I may have had a panic attack, since I had never had one, I didn't know what to expect, and he immediately put me on 1 mg Xanax 3xdaily. Now they will not even talk to me to give me advice on how to handle this new whirlwind of emotion, not how to safety decrease my dosage.

    Even if I were to accept that not one single doctor in your vicinity can see a new patient within a two month period, the solution to that problem is to drive to a larger community and see a doctor there, at least until you can get in with a local doctor.

    Just out of curiosity. Were you on all these meds while you were pregnant? You said you had a miscarriage. Did your OB tell you that Xanax is in category D for pregnancy, which means it is inappropriate? The other two are "C" which is not quite as bad. I can see totally how a responsible physician would have misgivings about prescribing this stuff to you during pregnancy. Especially the Xanax. If this doctor knew you were pregnant, you probably wouldn't be getting them at all.

    So you expect a doctor to keep prescribing you drugs without seeing you? I would actually argue that if they didn't drop you, they would be a chance of malpractice.

    Very true.

    On the other had though, it's a common practice to give the patient enough warning that s/he can find someone else.

    Now. That comes with a caveat. It's not the provider's problem if the patient has been "red flagged" because of the nature of the medications and can't find anyone to treat her; one cannot expect the physician to keep her as a patient regardless and neither will the law force him.

    It can be the provider's problem if the patient needs to be weaned off of medication to safely end its use, and the patient cannot reasonably find another doctor to prescribe a weaning schedule. We've not been told that was an issue here, but as an example, at higher doses an abrupt cessation of benzodiazepines can result in seizures.
