    Default Enforcement of Foreign Debt in the U.S.A.

    My question involves collection proceedings in the State of: Virginia
    I have a foreign student loan from Sweden that was taken out back in '98. It has been past due since 2006 and I just received a letter for a collection agency in California attempting to collect it. What are my options? 1- Would the statue of limitations apply?
    2- Can they add it to my credit report without a court judgment in the US?
    3- What can the collection agency do without a judgment?

    1. Yes, a statute of limitations will apply to any legal action taken through California's courts.
    2. Yes. It's money you owe.
    3. They can attempt to collect it from you. If you don't pay and they are authorized by the creditor to do so, they may seek a judgment or (if the creditor has obtained or obtains one in Sweden) seek to domesticate a foreign judgment for enforcement.
