I need some help.
I was divorced in Kansas in 1998 and both my ex-wife and I have since moved to Missouri (different cities). Child support laws are very different in these states. In Kansas, children emancipate at age 18 and upon graduation from high school.

I have been at odds with Missouri’s child support enforcement for the last 2 years because my child support obligation should be handled under Kansas law. I finally got feed up with their non sense answers (case workers claiming I must follow Missouri guidelines). I wrote a final letter stating I had already overpaid and I stopped paying.

Here is where it gets interesting. I recently received a letter from CSE acknowledging my assertion was correct and I have overpaid by $5,600.00. They sent my ex a letter telling her to return the overpayment to me. YEAH RIGHT, that is not going to happen in this lifetime.

Here is my question: Can CSE use a wage assignment on her to recover the money I was forced to pay by DCE or do I have to file suit against her to recover the money? Any help and case law citations would be appreciated.
