    Post Security Deposit with a Tenant to Tenant Exchange

    My question involves landlord-tenant law in the State of:
    Originally I moved in with 3 other roommates. myself and one other roommate gave our landlord our 30 day notice and moved out. The landlord did a walk through and said we will get our full deposit back and that the new tenant moving in has to pay us. The landlord and myself informed the new tenant and roommates that we get our full security deposit back and the new tenant has to pay us within in 21 days of us moving out. The old roommate is refusing to pay us and said it's the landlords responsibility to pay us our deposit. There is so much back and forth, I just want to know who is responsible for paying us our full deposit back?

    As a general rule, unless the rental agreement provides otherwise, a security is not divisible and thus remains with the unit after a co-tenant moves out. If you're telling us that you agreed to the continuation of your existing lease, with the new tenants substituting in for you on that continuing lease, then absent any surprises in the lease agreement the landlord can continue to hold the deposit under that continuing lease. If you're telling us something else, you will need to clarify the facts.

    Did the new tenant pay a security deposit to your former roommate or not?

    The new tenant did not pay a security deposit. The landlord told the roommates that the new tenant has to pay us our deposit back since they're taking our place in the house.

    We did not continue the lease with myself and the other roommate. The landlord had the new tenants sign a new lease with the other roommates
