My question involves labor and employment law for the state of: California
My employer has requested my resignation or will begin the process of termination (not for cause). This is a large corporation so there are several steps that need to be followed before termination.
My central concern is that my contract requires repayment of relocation, which was sizable, if I resign before 1 year. One of the senior managers has verbally promised not to pursue the relocation expenses, but he states he cannot put anything in writing. I also know that in large corporation, it may not truly be up to him whether they decide to come after me for the relocation expenses. I am very close to my one year anniversary.
I do not want to create any more animus than necessary, so I am currently considering writing the resignation with and end date to be one day after my one year anniversary. Would this provide me any protection? From reading around, I believe they could accept my resignation but move up the date, which would then put my resignation prior to a year and leave me liable to pay back the relocation, correct?
To be clear, my concern is not about unemployment compensation.
