    Default Moving Out Without Giving Full Notice

    My question involves landlord-tenant law in the State of: Florida.

    In my lease it says that 60 day notice to move out is required. I went to the office to look at another unit in the complex and after seeing nothing was available I told them I would be moving out. I never sent in the written notice so they will not let me move out on the scheduled date without penalty. They said I would have to pay a fine of one months rent. If I don't do that I can go month to month for 1 full month and stay in the unit for the month to month rate which is $400 more! Is there any way around this? I have already signed my new lease to start a few days before my original move out date. I can't afford to pay for 2 apts. Especially at the increased rate. I was never given a copy of my lease, I don't know if that matters or how I could prove it, just saying.

    No.

    You are breaching the lease.

    You owe it.

    It doesn't matter because getting a copy of your lease was your responsibility.

    You never, never, never, never, never, (to the nth power) sign anything without having a duplicate in front of you that you can take with you.
