    Default How Can a F1 Student Get an H1B Visa

    Hi People,

    I am a CS grad on a F1 Visa. I received my EAD card 9 days ago. I have not been able to find a job since the past one and a half month. I am planning on joining a consulting company so that I don't waste my unemployment days. Since, this is not my first preference I want to actively keep looking for opportunities.

    As H1-B visa applications will be accepted on April 1, 2015 the coming year by USCIS. I wanted to ask, how much time do I have to switch jobs so that the new company files for my H1-B visa? Would it be possible for the new company to file for H1-B visa if I join them in January 2015?

    Do companies usually sponsor visa if employees join them one month of two before formal H1-b application submission date?

    No company is required to sponsor H1B. It is far cheaper for them to hire someone on OPT so even if you are working for them, they may choose to terminate you and hire a more recent grad.

    You need to determine if you qualify for OPT extension so that you can make use of that if you desire to do so; ask your DSO. A company must be e-verified to employ you on OPT-EXT so determine the company's status.

    You need not be employed by a company for it to file for your H1B.

    EDIT: I wanted to add that you need to become better informed about H1B and OPT. The USCIS website should be your first resource. Direct your OPT questions to the international student office at your university.
