    Default Can You Get a Roommate Evicted for Giving Fake References to the Landlord

    My question involves landlord-tenant law in the State of: California

    I've been renting this condo for almost 5 years, with different roommates. The one I just got was approved by property manager to move in on January 3rd. I've been having tons of problems with him. He's totally insane! I'm scared of him and I have to lock myself in my room because I don't feel save. I know he gave fake references about his past landlord because he knew she was not going to give good references about him. I really want him out of this place. I can't keep living like this.

    We have a month-to-month contract and the property manager didn't let me the only tenant so we're both co-tenants but, I'm the one responsible for full rent. I never understood that. I actually never signed that paper. I feel it's unfair for me to leave, when I've been here for so long and he's just been here for a few months. Is there anything I can do to kick him out? Isn't the fact that he gave fake references enough to void that contract and look for another roommate?

    Also, if he finally agrees to leave and send notice, can I still send them a note I'm planning on staying?

    Unfortunately, without seeing a copy of the lease agreement, it is not possible to intelligently answer these questions. Under some contracts, offering material misrepresentations can be a basis for voiding a contract; however, the lease agreement itself would be necessary to answer further.

    The most concerning thing is that you do not safe. You should immediately communicate that concern to your landlord, and to law enforcement if necessary.

    what should i look for in the lease? Is there anything in particular that I need to look at?

    I don't feel safe and I notified the property manager, but she didn't address the problem. I don't really know what to do...

    What you need to look for in your lease is if you are this persons landlord. If not, it's up to management to get rid of this roommate. Unfortunately, you would have no legal ability to do so.

    Thanks! Unfortunately we're both co-tenants and the property manager functions as the landlord. I don't understand why the property manager gets paid to do her job (i.e. check prospect tenants' background) and if she doesn't do it correctly nobody cares and I'm the one who has to pay the consequences.

    Is whatever he is doing significant enough that you need to contact law enforcement?

    He hasn't been physically aggressive yet so no need to contact law enforcement. He's been verbally very aggressive. He also makes decisions that are from someone that is insane. For example he decided to deduct $50 from rent because "I use more cabinet space than him!" He never asked me for more space... What am I supposed to do?! Is that as simple as he decides what he wants?

    He also bring different girls he meets on the internet to spend the night here. I feel uncomfortable at my own place... I've been here for almost 5 years. He's only been here for 6 months...
