    Default Can I Sue My Wife for Rent Paid After She Moved Out

    Hello all. I've come here because I'm trying to find a real answer.

    It all begins with me and my fiancé moving into a nice little house in February of 2013. We both signed a one year lease. We got married in April of 2013. Things didn't work out between us, and she decided to move back in with her mother in November of 2013 and said she wanted a divorce. I come home from work one day and to my surprise she is gone, packed all belongings and moved out. I didn't hear from her for a while, until around our anniversary. She had got her very own apartment and still hadn't gave me any info on our divorce.

    I had informed the landlord that she had moved out in December and I have been stuck with the full amount of rent since November. I had to renew the contract with the landlord in May of 2014, taking her completely off of it and adding a new roommate to it. Here it is July of 2014 still no info on the divorce that she supposedly had filed and still stuck with the full amount of rent.

    My question to all is can I sue her for the time she was on the lease? How does that work? Thanks!!

    Tell us where you're located please.

    Ordinarily the answer would be "yes", but whether or not you'd be able to collect on a judgment against her depends largely on where you're located.

    File for divorce. Work it out in the divorce.

    Ordinarily, both spouses are responsible to maintain their own households after they separate. If you want contribution from a spouse it's best to get your case filed and to seek a temporary order from the court.

    You haven't indicated how quickly you found a roommate, but once that was done you no longer incurred any losses. You're certainly not "stuck with the full amount of rent" in any meaningful sense, once you choose to renew your lease and voluntarily take on that obligation without her involvement.

    My new room mate moved in in March '14. Not being able to afford the divorce on my part is an understatement. So if somehow I do come up with the money to file the divorce on my own, I can sue her for her portion of the rent from November 2013 to march 2014 right?
