    Default How to Stop Junk Debt Collectors From Pursuing Me

    My question involves collection proceedings in the State of: Pennsylvania

    I have several junk debt collectors sending me mail all the time. these debts are very old and most likely past the statute of limitations. How do I stop them from trying to collect? Should I send them a debt validation letter in which I ask them to prove that the debt is still within the statute of limitations?

    No. They can *try* to collect as long as they like. (by sending mail, calling, etc.) A request for validation (which honestly has such a low threshold as to be laughable anyway) only has to be acted on if it's been less than 30 days from their first contact with you. I suspect that is not the case for you.

    Okay, I'll try.

    Had you gone in front of the court at the time the judgement was made and shown AT THAT TIME that the debt was beyond the SOL, you might well have prevailed. However, that's a one-time defense that can only be used BEFORE there is a judgement against you. You blew the opportunity to use that defense when you didn't use it at the time. It's too late to use it now.

    Their only obligation in response to a request for validation, if sent within 30 days of their first contact, is to validate the debt. Most debt collectors will respond to a late request for validation, but only to validate the debt.

    You can express your interest not to be contacted by phone by making it in writing to the debt collector. This presumes that it's a third party debt collector and not the person who actually owns the debt (this includes junk debt buyer). There is NOTHING you can do to stop other attempts to collect (mail, etc...). Neither the FDCPA (which doesn't apply here) nor the Pennsylvania FCUA will provide you any release. All you can do is mail them back and point out the debt is past SOL. You have no legal redress until they actually try to sue you in court.

    That may be, but it doesn't negate the fact that you screwed up and are still trying to get out of paying your debts.
