My question involves collection proceedings in the State of: NY
Years ago, I refused to pay a bank certain overdraft fees because of how they processed the payments. I closed the account because of this, owing them money. Years later, I believe they settled out of court for erroneous overdraft fees associated with how they processed payments. I was obviously not part of the suit and never received compensation.
My debt was sold and now collections agencies are contacting me. The first company i reported to the BBB because they repeatedly lied to me and were rude and disrespectful. They refused to send me paperwork and when I spoke to the bank, the debt was sold to another company.
Now another agency is contacting me. They said they would email me some docs, so I am waiting in that.
What recourse do I have? I feel I should not have to pay this money because it is based on the banks failure to properly process my payments. What can I do?
Is it too late to take the bank to court? Or can I fight the collections agencies?
