In 2005 I left a company that I had worked at for 23 years. I had signed as a guarantor for one of the company credit cards. The company stopped paying and the card went into default in 2006. I refused to pay as I was broke and no longer worked at the company. I never heard any more about it until this past week. A collection agency in Texas is threatening to get a judgement against me if I do not pay. The statute of limitations in Nj and NY is 6 years. Can they get a judgement after the statute of limitations has passed? Is a judgement the same as a lawsuit?
I would definitely get a quick consult with a local attorney since it does appear that they are beyond the statute of limitations...and no, they should not be able to get a judgment beyond the statute of limitations. However, if they should try, it would be your responsibility to defend, in court, using the statute of limitations as your defense.
