    Default Can You Move a Roommate a Different Bedroom Against His Wishes

    Okay, So I live here in California. We have this roommate that doesnt do anything around the house pays rent late often and is a general nuisance. We asked him to move out multiple times, even gave his portion of the security deposit back for him to move when he had "found a place", which he spent and then didnt move. He currently has the master bedroom with attached bathroom and doesnt feel he needs to share the bathroom even though we have 6 people living in the house. He doesnt pay anything extra for this bathroom or room, and refuses to pay extra when rent time comes, when he does actually pay his rent on time that is. So basically, what I wanna know is what the question states. Is it illegal to move his room to one of the smaller rooms while he is away on a 3 month long trip, for which he only paid for 2 of the months.


    We're on a month to month at the moment, having had our lease run its course a few months ago. We are going to talk to the rental agency about resigning the lease to add people and have some others leave anyways, I just wanted to have someone weigh in on this before we went any further. Ideally we want him to move out, but this will ease things on everyone else.


    Oh, also, his room isn't locked or anything like that, so there wouldnt be any breaking into the room. Just a room swap.

    You chose rooms by whatever mechanism you chose when you took occupancy, and agreed at that time that your roommate was to receive exclusive possession of the master bedroom as his room, and agreed to divide rent in a specific manner at that time. Apparently he is on the lease along with you. If you want to make changes, I suggest ending your tenancy and renting again (there or elsewhere) without him.

    Frankly, if you did that to me as one of your roommates when I was away on vacation, I'd make sure to sue the bunch of you for coming into my room and "stealing" my very valuable "whatever" during this swap.

    It started out with three of us, in a 4-5 bedroom house. It wasn't an issue, but when we all agreed to move more people in, we agreed that things like him having his own bathroom needed to be changed as well, which he agreed to, but to this day refuses to acknowledge or agree with anymore. Basically, while the house as a whole has asked him to move out(when the lease was up) and agreed that the bathroom situation and stuff needed to be changed, he agreed but refuses to do it.

    As for the actual moving process, it would be video taped entirely from start to finish to ensure that that won't happen.

    The video can then only be used to prove what is on the video, nothing else. So before the taping started someone goes in and steals something, then you tape the full move. The video still doesn't prove that nothing was stolen, it only proves what is taped.

    this whole thing just sounds like trouble in the making.

    Video would also not catch every angle and nuance, and would provide at best a partial defense to claims that you damaged items you were moving.

    I suggest that you stop the adolescent scheming, and deal with your roommate issues adult-to-adult.

    If only that were possible. He's agreed to move out several times, its been 8 months since the first time. We were just looking for options before involving the landlord.

    What do you think the landlord is going to do? S/he's not going to get involved in a roommate dispute.
