    Default Eviction Upon Landlord's Refusal to Sign Lease

    My question involves an eviction in the state of: Colorado

    Landlord is not the owner, but a sublet to the downstairs of a duplex. Have agreements in text messages on how much rent would be, utilities included, and that it would be month to month. I had issues with an employer causing me to leave (this was a commissions job). I immediately found work, but had to wait to be put into the system so I could clock in and out. During this down time, my fiance and I were working with a rental assistance for July, as I won't get my first check until the 21st. We have to have a signed lease and eviction notice to receive help. Was able to finally catch him earlier today to talk about signing the lease and why it was urgent. He insisted on not signing and telling us we had 30 days to move. Honestly we were fine with that. Something cheaper would suit us better. Later at about 11 pm, he sent us this text message:
    "It appears there are things missing from our house, mostly assorted bottles of alcohol and I'm not actually comfortable with you girls staying here any longer. If you can provide some portion of the rent by tomorrow I will prorate the remainder of the month for you and give you as long as you can pay for. Otherwise we need to expedite the exit very soon. Without rent in hand and no contract you haven't a right to be there any longer."

    Neither of us have any idea what he's talking about with missing items. He and his girlfriend drink about every night, normally wine. My fiance drinks her beer that I know she pays for and I rarely drink. I've looked up the eviction laws and understand the 3 day pay or leave, and understand the FED. Does the text message constitute for three day notice? Do we have a right to retaliate for refusal to sign a written lease that could have helped us pay our rent? Rent is not due until tomorrow. We are living off of the money we get from plasma donations currently for gas and necessities. Any money we could give as a prorate would keep me from getting to work or get an essential phone shut off.

    Your "landlord" is blowing smoke out of a certain portion of their anatomy. If they believe this is a 3 day Pay or Quit they've missed a few items; for example, a text message of such means nothing.

    And no you have no "right" to retaliate for anything for not having a signed lease to receive financial help.
