    Default Is a Vehicle Owned by the Person on the Title or the Person Who Paid for It

    My boyfriends ex girlfriend came onto my property while no one was home and towed his jeep that isnt registered anymore cause he has a different vehicle now.. he has possession of original title but title is in her name. .. bill of sale is in his name..all money into that vehicle is from him...they haven't been a couple in ober 3 years. .. what right did she have for all of the above?

    She evidently owns the vehicle. That being the case, it's hers to do with as she please. Stand by though.

    The vehicle is titled to her. That makes her the legal owner. If he paid for it, he should have made arrangements to get the title transferred to him.

    Your boyfriend can certainly consult an attorney and try to convince the court that the vehicle is his, but it's going to be tough, and the judge is going to want to know how it came to be that she was on the title and not him.

    the apparent ownership is held by the person listed on the title. If any other person wishes to challenge that, they can sue. If they convince a judge they are the true owner, it can be transferred into that person's name.

    she had the right to take possession of her vehicle if that is what you are asking.


    he has possession of a certificate of title which in itself is only presumptive proof of ownership. The name registered in the state records as the title owner is what makes a difference. In this situation, it is presumably the girl so all she has to do is apply for a duplicate title and she is good to go.


    while he may have a bill of sale in his name, there is more to the matter than that. Apparently he gifted the Jeep to his girlfriend and as such, put her on the title.

    What state is this in? (Yes, it can be important)

    He has a "bill of sale" ... is it signed by her? Has it been registered with your state's DMV? Is HIS name anywhere on the paperwork?

    Are the police involved? If so, what did they say?

    The only reason the title was in her name was because he wasn't able to put it in his name at the time... he has had possession of car for over 4 years... the car is no longer registered. . Shouldn't she just be entitled to the plates? The battery that was sitting in the jeep belongs to me from my car..plus he had his own valuables inside the jeep... did she have the right to come on my property while I wasnt home and take things inside jeep as while that do not belong to her..?

    you need to explain that. Who are the parties on the bill of sale and what each party is listed as.

    .well that was dumb. Why would he store his own valuables, first, in a Jeep and second, in his former girlfriend's Jeep?

    So, there is no registered owner and the title is in HER name? Well, if the boyfriend is not the registered owner nor on the title, SHE looks like the owner of the car. Again, laws vary by state so knowing what state this is in can be important.

    You and your boyfriend can ask her for your stuff back, and maybe even ask the police to accompany you to her place to keep the peace while you get the stuff. But, the battery? Sorry, that's part of the car now. You or your boyfriend can sue her for what you have put in the car, but whether you win or not will depend on the respective arguments made by both sides.
