    Default Ex-Spouse Kept My Jewelry After Divorce, Then Sold It

    My question involves criminal law for the state of: Florida

    Ok so I had a miserable ten year marriage, we had two disabled kids, and finally got a divorce about eight or nine years ago. Since then, he's had a LOT of my jewelry. It's all 24k laser cut, from Saudi Arabia, all presents when I went to visit his family with our son. He estimated the value of the jewelry at over 10k when he asked my permission to sell it a couple of years ago. I refused permission, and demanded he give it to me. He hemmed and hawed and said he had to 'find' it.

    He strung me along for a couple of years, and since he is prone to violence he knew he could get me to back down if he screamed loud enough about the 'pressure' I was putting on him.

    Today he yelled that he sold the jewelry to pay taxes on the apt I am in, since he was letting me live there. (He owns the apt,and said I could live there rather than him pay child support, which I regret now)

    So yeah, basically he stole my stuff to pay taxes on HIS property so he could avoid child support. I am at a total loss of what to do now. It wasn't just one set, it was several, given to my children and I over a ten year period. I don't know when he sold it, or who to. He said years ago to sell it to a gold jewelry store, not a pawn shop I'd get a higher value, and that was when I started asking for it back, worried he'd do exactly what he did.

    Yeap. Florida SOL has expired (assuming the sale happened shortly after the divorce was granted)

    My question was,what were the chances of getting it back, and would the police have to be involved.
    If he sold it, it would have been in the last two years, as he sent me a pic less than two years ago of some of it, when I was pretending to be interested in selling it myself, in hopes of just getting it back.

    The problem is he is free to sell the jewelry belonging to the kids left in his custody. That only leaves yours in dispute.

    If it's not mentioned in the divorce decree, from what you've told us, you've allowed the statute of limitations to run.

    Also, you variably state that the jewelry was in the form of gifts to you, and also that it was gifts to the children. Was it one, the other, or both?

    You have the option of petitioning for child support.

    The children are in my custody, not his.

    It was both gifted to the children and myself. This wasn't one single piece, it was several sets, purchased over ten years.

    I didn't 'allow' the statute of limitations to run out, I wasn't aware the items had been sold until today. All along I'd been told the jewelry was safe, and I'd have it back any day. I guess I'm beating a dead horse at this point, lol.

    What do you mean, you didn't allow the statute of limitations to run? Tell us about the lawsuit you filed years ago, such that the statute of limitations did not run.

    You're still choosing not to tell us if this is mentioned in the divorce decree, but it seems reasonable to infer at this point that you didn't raise the issue then, either.
