    Unhappy Procedure for Response from Summons

    Around twenty days ago I received a letter from the sheriffs office stating I was being sued from MBNA Bank in Civil Court.

    Today I received a letter from the Law offices of Wolpoff and Abramson, LLP. indicating tha I am in default because I have failed to enter a written apperance personally or by attorney and file in writing with the court my defenses or objections to the claims set forth against me. I have ten days or a judgement will be entered against me. I recently refiled with National Arbitration against MBNA Bank for violation fo the truth in lending act. I have all the paperwork in which the bank agreed to a settlement check from 2 years ago. I just need to know how to stop this procedure and who do I respond to at the Civil Court?

    Procedures vary by state. You likely received at least basic instructions with the summons and complaint that were served upon you.
