    Default Landlord Wants to End My Tenancy, Claims Rent Was Not Received

    My question involves an eviction in the state of: IL

    My father and I had a rental agreement on a house he purchased 5 years ago. Since my prior home was foreclosed, he did not want me to have any paper trail of the idea of me paying him rent (house is completely in his and his wife's name) with the idea he would transfer ownership to me in 10 years when I paid enough rent to cover the purchase price.

    Now my father and I are having personal differences. Even though I have paid my rent on time for the past 5 years, I was two days late last week, and on the second day (literally minutes before I put the check in the mailbox), he called leaving a voicemail threatening to evict me and said that I should start looking for a new place to live (I still have the voicemail stating this). I had called him 3 days after sending the check, leaving a message asking if he had received it (I wanted to make absolutely sure), and also requesting a copy of the agreement on the house. I have received no response, no copy of the agreement, and the check is STILL not cashed (he would have gotten it one day after I had mailed it). He had said on the voicemail that if he didn’t have it by yesterday he would hire a lawyer and evict me and my sons. I know he has the check, and he always cashes my checks the same day he gets them.

    What would be the proper course of action on this? I have not been delinquent at all on my payments, this house is falling apart (no air conditioning and it is dangerous to live in – and my father would not fix anything at all), and I don’t want my kids living in such an unstable place – the upstairs deck railing just fell off of the house the other day, there is no air conditioning and the ceiling is buckling in two places. I have found another home to rent that would work great for my kids – they can stay in the same schools.
    I have just been through an expensive divorce and do not want to possibly be sued by my own father, so I am trying to make sure I have not missed anything. Any advice would be greatly appreciated.

    As suggested on another forum, send your father a 30 day written notice that you are terminating your month to month tenancy and be done with it.
