    Question Work Hours Conflict With Probation Curfew

    My question involves criminal law for the state of: Florida

    If I am on probation and have a 10pm Curfew, and get called into work and my boss states that I have to come in 3 hours early (4am)..Would that violate my probation or are there exceptions for work? Do I just have my fiance tell my P.O that I am working if she happens to come by?

    I suggest you call your PO and discuss how they want you to handle the situation.

    You need to contact your PO and inform them to see if there is any possibility of getting your curfew modified for that day. You should also inform your boss that unless the PO approves the change, you cannot come in early. Your PO may require a written statement from your boss to modify your probation or they may call or stop by to speak with your boss. How they run things is up to the local practices.

    If this hasn't happened yet but you expect that it might happen I suggest you talk to your PO and your boss ASAP about how to handle it.

    The first time you refuse your boss is likely the day you get fired.

    The first time you get caught missing your curfew you get violated and sent back to finish your sentence.

    The only reason it is difficult to notify my P.O when it happens, is because they are rush overtime jobs. My boss may not get the call until 10pm that we have to work on the motor that night. I see her again in a week. I will just have to let her know that sometimes I get called in overnight. And I can't say no because it is only the owner and I that work there. It's a small business.

    You NEED to talk to your PO about how to handle this NOW not when it comes to the day you need to work past curfew.

    I am positive that your PO has a phone. You need to call your PO before it happens, not as it is happening. My first response to a call that comes through as the situation is happening or after it's already happened is, " you waited all this time to tell me this?" You already know that there is a problem, whay are you waiting a week to discuss it?

    Like the others have suggested:

    pick up your phone NOW and call your. PO NOW.

    Ask them if you can be granted a modification of your curfew for incidents like you describe. Ask if it can be an ongoing modification so you don't have to freak out every time the boss asks and if there are any special stipulations like having your boss write a letter each time you work the odd hours or anything else your po might ask of you.

    Then use your brain and your phone and call your PO NOW to get this resolved.

    well, when you get violated and tossed in jail for contempt of court, I guess you won't even have to worry about saying no.


    Yes, you can say no and you would be an absolute fool to not say no unless your PO has approved the issue.
