    Default How to divorce a missing spouse

    I have got to divorce this man. We have been married toooooooo long and it has just been more seperation than together. He is and has been in another state for the past 11 years and have no clue as to exactly where. We have 2 children 18 and 11 to which he outright refuses to pay child support for. It is awful and I need to be legally disconnected from that man so I can move on. Please help.

    You can get a divorce. If your husband cannot be located, you (or your lawyer) can ask the court to permit substituted service - service which, although not made personally on the defendant, is considered by the court to be sufficiently likely to inform him that the legal action is pending.

    Thank you Jesus!! Thank you so much. You have no idea how relieved I feel right now. So I can get my divorce without finding him to sign and not worry with the idea of visitation etc. What do I need to do to get started. I called the county court/family and they said contact an attorney who requested an ecormous retainer. What about an attorney? Do I need one really?God knows I don't have much with raising my children alone. Also,How long would it take to be unattached.

    You can buy a "how to handle your own divorce"-type book at a local or online book store, and try to handle the divorce yourself. If that seems too complicated, shop around for a less expensive law firm.

    Thanks. Today I became so discouraged. I called the county again and again it was a mess. This time I was told if I don't know what to do prior to seving then I have to get an attorney. Isn't there a website or something explaining the process under the state of Alabama? Please help?!
