    Default Are State Claims for Car Accident Damage Dischargeable in Bankruptcy

    My question involves bankruptcy in the state of: Maryland

    A couple of years ago I was in an accident in the State of Maryland. My husband at the time, whom I was separated from had ended the insurance on the vehicles and I didn't know. The state came to the conclusion that I was at fault for the accident. Obviously the insurance company didn't handle the claim from the state due to my ex cancelling the insurance. I am going to have to file for bankruptcy. The state is trying to charge me $26,000 for the accident. There was never a court case or anything. Can I include that in my bankruptcy?

    Yes.

    As long as the accident was caused by your negligence and didn't result from alcohol, drugs, or intentional acts.

    No it was not a result of drugs or alcohol. And definitely not intentional. Thank you very much I will review the article.

    Has the state suspended your driver license for the uninsured accident?
