    Default Does My Employer Have to Pay Me for 2 Weeks if I Give Notice

    My question involves labor and employment law for the state of: Oregon.

    At my company, we have had a couple salaried employees leave and go to a competitor. They were walked out the day that they gave notice, but still paid for the two weeks. As I am an hourly employee, if I left to go to a competitor and was walked out the day I gave my notice, would my current company still have to pay me for the two weeks as well?

    unless you or they have a contract requiring you to be paid for the time, no, the only time your employer is required to pay you is for time actually worked.

    That is what I thought, but does it matter that they have paid the other employees for a full two weeks?

    Just as a side issue, when an employee gives notice it is not unusual for an employer to terminate them on the spot because they are deemed to no longer be 100% loyal to the company and out of fear that they may steal trade secrets or proprietary information, or sabotage things in the workplace during their last few days on the job.

    Oregon law states that when an employer terminates a staff member who has given notice, ending wages must be paid within a certain time frame (which varies based on the circumstances of the situation). If ending wages are not paid within that time frame, the law says they must continue until they are paid as a penalty for failing to do so.

    It could very well be that the salaried employees you speak of were terminated but wages were continues as a penalty simply because bookkeeping would not be able to process their final check until the next pay cycle. I would not count on yourself necessarily falling within the same circumstances.

    No, it does not matter a whit whether they paid the other employees. FYI, there is only one state where an employer is EVER required by ANY law to pay ANY employee beyond the last day they actually worked; even in that state the law does not apply in all circumstances; your state is not that state.

    But it is 100% legal, in all 50 states, to manage exempt and non-exempt employees differently.
