    Default Class D Felony

    i live in indiana i have been charged with a class d felony. ive been accused of taking a turkey dinner to a sick relative. i was a deli manager until all this happened. my in law ordered a turkey dinner and said that she paid for it. she said she had the reciept. this all happened on the anniversary of my husbands death. i delivered the dinner and when i got there i took the reciept from her and left. when i got to the store i looked at the reciept and it had another stores name on it she was confused (shes 80). I decide then that i would pay for it. but i didnt have the price tags . so when i went in the deli i was looking up the codes and the store manager came up and took me upstairs.i offered to pay but they refused. could you please give me some kind of idea whats going to happen to me. my bond was $250. i turned myself in.the dinner was worth $79.99 the pie was $5.99 and the delivery was $25.00

    You are going to need an attorney, he/she will be able to look at any possible defenses you may have in hopes to getting the charge lowered.

    A Class D felony for theft (if found guilty) is punishable by not less than 6 months to 3 years in jail, with a potential fine up to $10,000. The sentence, however, can be suspended and just probation and fines could be imposed.

    Make sure you don't lose the receipt for the actual dinner that was purchased.

    You cannot be convicted of theft unless you actually intended to steal. A statement from your relative and the receipt if it is for the same items should show it was just a mistake. Retain an attorney and you should be OK.
