    Default Amending a Petition After the Deadline

    My question involves court procedures for the state of: Texas

    Harris County, Texas District Court.

    The petition was amended after the deadline listed on the docket control order; however, defendant responded to the included request for disclosure and has not raised the issue yet. What effect, if any, does that have on the amended petition's viability. No one has mentioned it yet. Trial a few months out. What is the best action to take to protect the amended petition?

    If you don't object to something, you should not be surprised if the court later deems you to have waived the issue. The rest depends on the facts.
