    Default Denied a Promotion Because of False Statements

    My question involves a cases of discriminations.

    Hi, recently there were a few promotions given at my place of employment. I’m the oldest employee here, (that is, I’ve been here longer than all the others). Recently the top head person of the department I work in, wanted to get my views as well as those of my coworkers in regards to the filling of these positional slots. The slots were filled by others that have less time than myself. While communicating with the top head person, he mention that my former supervisor had told him that he and I had spoken about these positions and that I had mention to him that I did not want to take on this Supervisory role nor the role of the Coordinator. Now here’s the catch, this individual nor myself have never , ever approached one another to even discuss the possibility of me moving into one of these position. He intentionally took upon himself to make this false statement to prevent me from becoming the supervisor or the coordinator of this department. Once again, I have never told him nor spoke with him in regards to either position. Let me say, being the only minority in this department and having gone to HR in the past about this person bias attitude towards me. I believed this person has step over the line and directly discriminated against me. Could you please help by telling me how to go about pursuing this matter further, think you?

    At this point you don't know that your former supervisor ever said word one to the head of the department. You only know that the head of the department says he did. For all you actually know, it could be the department head who is lying. Or no one could be lying, but someone misunderstood something.

    Then, too, there's how you are planning to prove that but for this statement that may or may not have been made, you would definitely have been promoted.

    Do you see the difficulties here?

    I was informed by the top head, that this person was supposed to come and speak with me in regards to this statement, but he never did. I’m assuming the reason he avoiding me is because it's true.

    That is not a safe assumption to make. It could just as likely be that the top head made up the whole thing, and the reason the supervisor has not come and talked to you about it is that he knows nothing about it.

    Having a supervisor lie about talking to you and another supervisor not decide to make a re-determination of promotions is not illegal.
