    Default Company Shipped a Replacement Product to the Wrong Address

    My question involves a consumer law issue in the State of: California.

    Hello everyone. To make a long story short, this company I purchased items through was sending me a replacement product for something of theirs that broke within warranty. I opted for Advanced RMA and paid a deposit for $69.99 to receive the product first before I ship mine back. However they sent it to the wrong address somehow, in a completely different state.

    The product was delivered to this address 3 weeks ago now. Most likely the product is long gone and taken by someone for free. I have called, contacted the company countless times asking what they are going to do to fix this. Every time they tell me they are contacting UPS to have the package redirected to me. I then explain to them every time they tell me this that the package can't be redirected if it has been delivered 3 weeks ago and is long lost.

    The company keeps telling me they will have a answer for me by end of the day, this was 2 weeks ago the first time they told me this. they tell me it again every time I call. Before this package was delivered to the wrong address I contacted them and told them that the tracking number is going to a different state. The same day the tracking number was valid to track on UPS webpage. This was plenty of time for them to redirect the package as it was in transit for multiple days. Long story short is, what can I do? They have my money for a deposit, I have received no item, the warranty conveniently runs out next month like they told me which is why I don't them to delay it to July 1st then tell me oh well no more warranty good bye. Any advice anyone? Thank you in advance, just extremely frustrated.

    I suggest you take the tracking number to UPS and see if they can print out a duplicate of the label.

    If the label was printed with the wrong address by the seller, you'd have more leverage against the seller.

    But if the label was correct and UPS misrouted the item then your beef is with UPS and not the seller and I don't see any obligation on the part of the seller to deal with UPS on your behalf.

    Meantime, I suggest you send back the defective item and get your deposit money back. That's a whole separate issue from the lost package and if you fail to do that before the warranty expires you are likely to be out of luck.

    I requested the label from UPS at it has the wrong address on it from the seller. I talked to UPS the day it shipped notifying them but they couldn't redirect it without the sellers confirmation which is why i told them immediately and did nothing in the 4 days of transportation.

    Then your recourse is against the seller.

    But you still have to return the old one within the warranty period and get your deposit back.

    Then you'll be in a position to go after the seller.

    Until you do that I can guarantee that the seller isn't going pay any attention to you.

    If you don't get the item sent back on time, you've got nothing and you lose the deposit and whatever you paid for the item.
