    Unhappy Ticket for Loud Muffler, Unnecessary Squealing of Tires

    My question involves a traffic ticket from: Columbus Ohio, Franklin County

    I'll kept it short and sweet, it was night time, dry roads, and the police officer had tailed me for about a mile before he stopped me. I drive a manual civic si (still getting used to the tight clutch) and have owned it for 3-4 weeks.

    Details:
    I stopped at a red light, at a T intersection, turned right and accelerated fairly heavily, not has fast as the car can go, shifted into second and for some reason my tires chirped slightly, I was already moving (traveling about 25mph) not attempting a "burn out." Then I had drove about a mile maybe more, he followed me to the highway and waited some more before pulling me over. Where the incident happened there was no other drivers around. Now when I bought the car it already had an aftermarket muffler on it, purchased from a honda dealership.

    -If the muffler is illegal, would that be the dealerships fault for selling it to me?
    -Is there an infraction for following me so far before pulling me over?
    -Is there leeway with learning a new clutch?

    Question I forgot to ask, is this considered reckless driving? The "chirp" from my tires was less then a second, literally. I would consider the words "unnecessary squealing" a complete exaggeration.

    Not sure about that, but the angle I would approach it from is if the muffler is illegal and the dealership provided a valid inspection certificate with the muffler in place then they could be in trouble for that.

    Nope, maybe he was just going the same way as you were. They are public roads after all.

    Nope and you've already had the car for a month, how much learning curve do you need?

    The dealer may be in trouble, but that doesn't get him out of the equipment violation. Cops are allowed to follow you around to see if you're going to commit more crimes, or perhaps give them signs that you may be intoxicated. I used to work a shift where I was on the road between 2-3 AM. Can't tell you the number of times I've had cops follow me or pull me over on nonsense stuff (fortunately not cited) just to see if I was drunk.

    What exactly were you cited with?

    As said earlier the dealership could certainly get in trouble, but that would be in addition to you, not instead of you. If the muffler is illegal, do you intend to replace it? If you do, and can get it done before your court date then the judge MAY accept a claim that you did not realize it was illegal, you bought it that way, and as soon as you found out you arranged to get it fixed. Not knowing (or claiming not to know) does not make you any less guilty, but combining that with evidence you immediately rectified the issue is something that has many times lead to a judge dropping charges.

    No, there is a good chance he was trying to see if you were drunk, also possible that he called in your license plate to make sure the car wasn't stolen or anything.

    No, and quite frankly it is not a good excuse. If you present that infront of the judge it will likely get you no where. Inability to operate your car is no better than intentionally operating it poorly.

    Ohio if pretty vague on exactly what Reckless driving is. A lot is left up to the interpretation of the officer and the court. I don't think it would be reckless, but my opinion doesn't matter, and if you are being charged with reckless you need to take it seriously. All tire squeal is unnecessary, the exception being rapid breaking to avoid an otherwise unavoidable accident.

    Not seeing the dealer in any trouble here at all. They are not responsible for a person installing aftermarket equipment that does not meet state requirements. If they installed it with the assurance that it meets state requirements op would have an action against them but otherwise don't see any problems the dealer would face here.

    Cant give you much on the tire chirping without the cops input. Honda's aren't powerhouses to start with so how got them to chirp is curious in itself but a little chirp that would be from not being able to drive a stick, well, can't see a cop giving a ticket for that. If that's what it was, that may be why the cop followed so far and if your further demonstration of driving showed you actually could drive a stick adequately, then he may have concluded the chirp was intentional

    The "might be in trouble" was qualified with the "if the aftermarket muffler was on the car when inspected and they improperly passed it." Despite the odd wording in one of the posts, reading the first one it's pretty clear he bought the car with that muffler already in place.

    Anyhow, in most places, but I'm not going to look up Ohio to be sure, equipment violations can be mitigated by fixing the vehicle. Either by statute or by general goodwill courts tend to dismiss such repaired violations.

    Of course, the OP hasn't bothered to answer the question of JUST WHAT EXACTLY WAS HE CITED FOR yet.

    I would take that they were cited for a loud muffler and unnecessary squealing of tires.

    OH does not require inspection of vehicles prior to sale. All this is on the OP, unless he paid the dealer to install the muffler.

    Sorry for the delay!! I really appreciate everybody's advice!

    Two seperate citations under the box entitled "other offense" with "unnesesary squealing of tires" (2133.071A) and" loud muffler" (2137.20A) hand written in. The actual ticket states "Total # of offenses: 2"

    But I did not request the dealership to install the muffler, it was already excisting. While I was pulled over, the officer never mentioned anything about a decibel test; is that common practice? He just said it was too loud, here's a ticket. Thanks again!

    hey man I just got this same ticket, what happened and what did you get when you went to court?
