My question involves landlord-tenant law in the State of: New York
I signed a 1-year sublease, but now want to break it. Can my landlord (who is also my roommate) keep my security deposit? And can he pursue me for additional rent after I move out?
I knew in advance that my landlord wanted to keep some pieces of furniture in the room and store two items in my closet. I was fine with that. But he had said that a bed frame and mini fridge left by the previous tenant would be gone by the time I moved in—they weren't. I also found out later that he planned to move another piece of furniture from the living room into my bedroom. I don't want my room to be treated like storage, but I don't feel like I can say no. My concern is that this landlord-roommate relationship is only going to worsen with time if things like this are already happening within the first few weeks.
My other concern is the bathroom lock is broken, but he doesn't see any need to fix it or want me to pay out of my own pocket to fix it. Also, he acts a bit strange. I stored a pot in the common kitchen cabinets after I made sure it was okay with him; the next day, he placed that pot on the counter. Then, the next day he approached me and asked if I could store the pot in the cabinets because he wanted to keep the counters clear. Subsequently, he started moving my cookware from the top of the oven, into the oven, into a cabinet and finally into a different cabinet. Plus, the day after I moved in, he started talking to me in detail about his sex life, dating history and misogynistic views.
My landlord is also a real estate broker so I'm sure he knows the laws better than I. While none of his quirks are impossible to live with, they add up to an extremely uncomfortable environment. The previous subtenant was a really good friend of his, but my landlord still took the friend's security deposit (albeit the friend gave 4-days notice before moving). So what is the likelihood of me leaving this situation without having to lose my security?
