My question involves criminal law for the state of: California
I caught a guy who lives in the same house as me, in my bedroom with the intent of stealing. He climbed in through my bedroom window while i was out. I came home and found him in my room. I had him arrested. He has been charged with residential burglary. He has been locked up ever since the incident, which was 10 days ago. a $125,000 bail has been set. He and his friend seem to think that he will only be convicted of trespassing, because he did not have any stolen property on him. It doesn't matter if he had any property on him or not, he was busted in the act...Is this guy going to be able to cop a plea to a lesser charge?
