My question involves traffic court in the State of: Florida, Sarasota
Want to fight run-of-the mill b.s. radar ticket I got at night on county road, limit 35, bitch cop (I hate female cops) tells me her radar show +13. The road was empty and she used moving radar, approaching me on opposing lane. The road was two lane, pretty straight, no people or traffic. Also limit 35 is huge pile of dung on this road as it can easily be 45.
I hadn't started my car for a month due to being away and was just driving it around and reving the engine in second gear, sometimes third, to 'loosen' it up. Was just so unlucky, at wrong place, wrong time.
Fine $206. My record was clean for almost 12 years until now. It's so annoying and I don't want to pay that much.
I am this close to pleading not guilty and going to court. I have no court experience sadly but I've been reading day, night. Also I'm reading the TIPMRA website for defense, and it's some great stuff, although a bit law-oriented.
First I am hoping to make a 'plea bargain' where they just reduce to ticket to +9 I will save over 70$ this way. Do I know this is going to be offered to me before start of trial?
If not, I'll just go in there and starting grilling cop on radar calibration, maintenance, her training on radar and the particular model she had in car, I will show them applicable case laws governing the subject, and even ask if she tuned her gun with tuning fork before and after my citation. I believe there's case law for this too.
Do I have a decent strategy or am I just in for worse? Also should i do motion for discovery at all, and what material should i request?
